Maternity insurance

If you are a salaried employee:

you are entitled to:

  • 100% coverage of benefits in kind intended to cover pregnancy expenses
  • Compensation for loss of salary due to maternity leave for 14 weeks, i.e. 98 days. .

Legal basis:

  • Law 83-11 of 2 July 1983, amended and supplemented, relating to social insurance.
  • Decree 84-27 of 11 February 1984 setting out the terms and conditions for the application of Title II of Law 83-11 of 2 July 1983

Documents to be provided:

  • Certificate of initial confirmation of pregnancy (3 months) stamped within the required time frame,
  • Prenatal examination certificate (6th month);
  • Prenatal examination certificate (8th month);
  • Certificate of delivery,
  • Birth certificate,
  • Certificate of postnatal examination, at least 8 weeks after delivery.
  • Certificate of sick leave for 150 days,
  • A certificate of employment and salary indicating salaries and days worked (ATS duly completed by the employer)
  • A declaration of return to work or non-return to work.

To be eligible for these benefits, the insured individual must meet the following conditions:

100% benefits in kind:

  • Insured status,
  • Proof of a minimum period of employment:
  • 15 days during the 3 months preceding the date of benefits in kind to be compensated or 60 days during the 12 months preceding the date of benefits in kind to be compensated (ART 54 of LAW 83-11)
  • Submission of prenatal and postnatal examination certificates within the specified time frame

Cash benefits

  • Proof of a certain period of employment:
  • 15 days during the 3 months preceding the first medical confirmation of pregnancy or 60 days during the 12 months preceding the first medical confirmation of pregnancy (ART 55 of LAW 83-11)
  • In addition to the working period requirement mentioned above, the insured individual must not have stopped working for reasons other than those compensated by social security during the period between the date of the first medical confirmation of pregnancy (3rd month) and the date of delivery (ART 32 of Decree 84-27)

Maternity leave payment:

  • Payment for 21 consecutive weeks of maternity leave (150 days) from the effective date of stopping work;
  • The daily allowance is equal to 100% of the daily salary subject to contributions after deduction of social security contributions and tax

Important:

  • Work stoppage occurring within six weeks before the expected date of delivery is covered by maternity insurance, and in such cases, maternity leave will begin on the first day of work stoppage observed during this period.
  • The insured individual may request that the maternity leave payment be split, provided that she regularly submits the declaration of return to work or non-return to work
  • Entitlement to maternity insurance benefits is available for any interruption of work due to pregnancy occurring after the end of the sixth month of pregnancy, even if the child is not born alive
  • 100% coverage of benefits in kind is conditional upon the declaration of pregnancy to the social security agency at least 6 months before the expected date of delivery and upon the timely submission of prenatal and postnatal examination certificates (3rd, 6th, 8th month and after delivery) Failure to complete these formalities within the specified time limits will result in a 20% reduction in the benefits owed, except in cases of force majeure.
