Presentation

The management of work accidents and occupational diseases has always been a major focus of social security organisations.

This is because the revenue of these organisations comes mainly from employers’ contributions for their employees, in accordance with legislation.

It is well established that prevention is the appropriate tool for dealing with risks and that a prevention policy conducted in this spirit is capable of effectively responding to the tragedies experienced by thousands of workers and controlling the costs increasingly incurred by their care by the National Social Insurance Fund for Salaried Workers. This involves the implementation of all mechanisms aimed at preserving the health and safety of employees in order to anticipate and limit the human, economic and social consequences of occupational accidents and diseases.

The main legal bases are:

  • constitutional provisions enshrining the right to health protection, hygiene and safety at work;
  • Legislation governing labour relations (in particular Law No. 88-07 of 26th of January 1988: JO No. 4 of 27th of January 1988 on hygiene, safety and occupational medicine and implementing texts which guarantee this right by defining the measures to be implemented to ensure the protection of workers.
  • Law relating to the protection and promotion of health (85-05 of February 16, 1985).
  • Law n° 90-11 of April 21, 1990, relating to labor relations
  • Law 83-13 of July 2, 1983, amended and supplemented, relating to work accidents and occupational diseases, under which the CNAS intervenes to:
  • Ensure the application of legislation and good practices in risk prevention.
    • Participate in the promotion of health and well-being at work;
    • Provide solidarity by offering compensation and social assistance to workers who are victims of workplace accidents or occupational diseases and to their families.
    • Support victims and facilitate their rehabilitation and socio-professional reintegration (equipment, etc.).
